Please read these Terms of Service ("Terms") carefully before using the PhotoFramr website and image editing tool (the "Service"). By accessing or using PhotoFramr, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

PhotoFramr is a free, browser-based image editing tool. It provides features including blurred frame composition, image cropping, background removal, image upscaling, and file format conversion. All image processing occurs locally within your browser — no images are uploaded to our servers.

PhotoFramr is provided free of charge and is supported by advertising. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

2. Acceptance of Terms

By using this Service, you confirm that you are at least 13 years of age, or that you are accessing the Service under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. You also confirm that your use of the Service complies with all applicable laws in your jurisdiction.

3. Your Content and Intellectual Property

You own your images. PhotoFramr does not claim any ownership over the images you process using the Service. Because all processing happens locally in your browser, we never receive, store, or access your images.

You are solely responsible for ensuring that you have the necessary rights, licenses, or permissions to process the images you use with PhotoFramr. Do not use PhotoFramr to process images you do not have the right to modify or distribute.

4. Acceptable Use

You agree not to use PhotoFramr to:

Process, create, or distribute illegal content, including but not limited to child sexual abuse material (CSAM)
Create deceptive, misleading, or fraudulent content intended to deceive others
Infringe on the intellectual property rights of others (e.g., processing copyrighted images you do not have rights to)
Violate any applicable local, national, or international laws or regulations
Attempt to disrupt, overload, or interfere with the proper functioning of the Service
Use automated tools or bots to access the Service in a manner that exceeds normal human usage patterns

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION:

Warranties of merchantability, fitness for a particular purpose, and non-infringement
Warranties that the Service will be uninterrupted, error-free, or secure
Warranties regarding the accuracy or quality of AI-generated results (background removal, upscaling)
Warranties that the Service will meet your specific requirements

AI features (background removal, image upscaling) use machine learning models that may produce imperfect results. You are responsible for reviewing outputs before use.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGE TO BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid for the Service in the twelve months preceding the claim. Since PhotoFramr is provided free of charge, this amount is zero.

7. Third-Party Services

PhotoFramr uses the following third-party services, each governed by their own terms:

Google AdSense — for advertising. Subject to Google's Terms of Service.
Hugging Face Hub — for hosting AI model files downloaded by your browser. Subject to Hugging Face Terms of Service.
jsDelivr CDN — for hosting the Transformers.js library. Subject to jsDelivr Terms.

We are not responsible for the availability, content, or practices of these third-party services.

8. Indemnification

You agree to indemnify and hold harmless PhotoFramr and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be indicated by an updated "Last Updated" date at the top of this page. Your continued use of the Service after changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you should stop using the Service.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved in the appropriate courts of competent jurisdiction.
